SIMS Rape Case: HC dismisses anticipatory bail applications

The anticipatory bail petitions were filed separately by the accused and the three co-accused and it was listed together before the single bench of the high court Justice MV Muralidaran.

Manipur High Court on Saturday dismissed the anticipatory bail applications filed by the main accused and co-accused of the alleged abducted and rape case of Saina Institute of Medical Science (SIMS) student.

The apex court also vacated the interim bail granted to the accused Yumnam Surjitkumar and co-accused Y Nonibala, Laishram Kunjarani Devi and SK Wajid Shah on August 31.

The anticipatory bail petitions were filed separately by the accused and the three co-accused and it was listed together before the single bench of the high court Justice MV Muralidaran and disposed of together since the parties and the points for determination are one and arising out of the same FIR.

"This Court does not find anything on the record to satisfy itself, at this stage, that there are grounds or more to say reasonable grounds for granting anticipatory bail to the petitioners. Thus, this court does not find any merit in the anticipatory bail applications of the petitioners," mentioned the court's order. 

It also stated that the observations made in this order are limited to the question of considering the anticipatory bail to the petitioners and the court has not delved into the merits of the offences levelled against the petitioners. 

According to the complaint lodged to the police by the victim family, Surjitkumar, in collaboration with the three accused, had kidnapped the victim and rape her on the night of August 14, 2022.

On the other hand, family of the Surjitkumar claimed that that it was not a rape case, it was an elopement with the consent of the victim who had love affairs with the Surjitkumar since the past five years.

Mentioned may be made that the Session Judge, Imphal West on August 31 had also rejected pre-arrest bail applications filed by the three co-accused and vacated their interim bail, however none of the accused persons have been arrested by the police till date.
