Rape convict sentenced to 16-year rigorous imprisonment

The Special Judge (POCSO), Churachandpur, Manipur recommended providing compensation of Rs 5,00,000 to the victim.

Special Judge (POCSO), Churachandpur on Wednesday sentenced a 32-year-old man to rigorous imprisonment for a period of 16 years with a fine of Rs 25,000 under section 4 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.

The accused Chinminthang, 32, son of Lianzamang of Simbuk village, Churachandpur was convicted on December 27 under section 4 of POCSO Act, 2012 for committing penetrative sexual assault in 2017 to minor girl, which is punishable with imprisonment of either description for a term which shall not be less than seven years but which may extend to life imprisonment and should also be liable to fine.

The court on judgment directed that the period for which the accused has already undergone judicial custody during the period of investigation as well as during the trial, if any, will be set off from the sentence awarded.

Furthermore, the court also recommended providing compensation of Rs 5,00,000 to the victim under the Manipur Victim Compensation Scheme, 2019 as per section 33(2)) of POCSO Act as well as under section 357A of the Code of Criminal Procedure to the Victim.
