POCSO convict sentenced to 10-year rigorous imprisonment

The court convicted the accused for committing sexual assault on a minor girl of 17-year-old in August 25, 2018.

The Fast track special Court No 2, Manipur on Monday sentenced a man convicted of committing a sexual assault to 10-year rigorous imprisonment with a fine of Rs 2,000 in default payment under POCSO Act.

The convict namely Nemengcha alias Thangtinsem Khongsa, 27, son of Eto Khongsai from Saikhul Ng Phainom village, Kangpokpi district was convicted by the judgment of the court for offense punishable under section 366 IPC and for the offense punishable under section 4 of POCSO Act, 2012.

The court convicted him for committing sexual assault on a minor girl of 17-year-old in August 25, 2018. 

The father of the victim lodged a complaint to Women Police Station in Thoubal, stating that his daughter was kidnapped from Thoubal by the convict to be his wife and sexually assaulted before abandoning her at Uripok area about 1 km from Imphal city on the following day.

The rapist was arrested from Thoubal parking near Johnstone Higher Secondary School, Imphal on August 30, 2018, as per dossier of the court proceedings.

The court during its hearings observed that prosecution hassuccessfully proved the charges against the convict and convicted him under Section 366-A IPC (kidnapping) and Section 4 of POCSO Act (sexual assault of minor).

The court awarded a compensation of Rs 6 lakh to the victim, who has now attained the age of majority, for her physical and mental trauma suffered by her in the incident.

The court further stated that the awarded compensation should be paid by the state government from the victim compensation fund or any other scheme under section 357-A CrPC through District Legal Service Authority, Thoubal.
