Murder charge framed against accused for killing nephew

The charge was framed as materials of the prosecution available on record were found sufficient under section 447/302 IPC and 25 (1-8) A. Act.

Session Judge, Imphal West on Monday framed murder charge against one Gurumayum Birachandra alias Molecule who was arrested for allegedly shooting his nephew to death on November 21.

The charge was framed, as materials of the prosecution available on record were found sufficient under section 447/302 IPC and 25 (1-8) A. Act.

The investigating officer of the case submitted the charge sheet against the accused before the Chief Judicial Magistrate, Imphal West and transferred the case before the Session Judge on January 4 under Section 209 CrPC being exclusively triable by the court of sessions.

During the course of investigation, it was found that there is no evidence against Molecule’s daughter, Gurumayum Gita Paras, 47, who had been arrested as an accused; therefore, being punishable under section 120B-IPC has been lifted from the case.

After completing the investigation, the investigating officer of the case submitted a charge sheet for the offences under section 447/302 IPC and the section 25(1-b) Arms Act against Molecule.

During the hearing, additional public prosecutor for the state submitted that sufficient materials exist for framing charges against the accused person for the offences under section 447/302 IPC and the section 25(1-b) Arms Act against Molecule.

The counsel of the accused submitted that the materials relied on by the prosecution have failed to make out any case against the accused and prayed for discharging the accused from liability in the case. It was also submitted that there are many contradictions in the prosecution story. It was further submitted that the accused had no intention to kill the deceased identified as Gurumayum Surjakumar, 34, son of Gope of Chingamakha Ngakraba Leirak.

After hearing the submissions and considering the records, the court announced charge is to be framed against the accused for the offences punishable under the sections of law.
