Man arrested with drugs gets three years jail term

The convict was arrested along with 360 numbers of Spasmo-proxyvon from an area near Lilong police Station by then Inspector Asem Chaoba, OC NAB Manipur on July 16, 2006.

Special Judge ND&PS Fast Track Court Alek Muivah has sentenced Md Shikandar for three years rigorous imprisonment and to pay fine of Rs 20,000 and undergo simple imprisonment of 2 months if fail to pay the fine under section 21(b) of ND&PS Act.

Md Sikandar, 26, son of Md Nasir of Lilong Heinou Makhong was convicted by the same court on February 28, 2023.

Notably, Md Sikandar was arrested along with 360 numbers of Spasmo-proxyvon from an area near Lilong police Station by then Inspector Asem Chaoba, OC NAB Manipur on July 16, 2006.

Special public prosecutor prayed for awarding maximum sentence as exemplary.

Defense counsel, however, pleaded that the convict has no criminal antecedence and bears good moral character. The convict is raising his four young children along with his wife by running a small shop. Incarceration of the convict will unstabilise the family and pray for leniency.

“I am conscious of the fact that a sentence that is too harsh sentence and too lenient sentence, both lose their significance. In this case, the convict nowhere claims that the seized contraband item was for his own consumption meaning thereby the same was for sale to others. Most of the Narcotic & Psychotropic substance’s victims are young persons and its effect on the youth and society is disastrous. If unchecked and not controlled it could wipe away the whole generation in any given society”, the Judge opined.

The period of 37 days already spent in judicial custody may be set off from the period of sentence awarded under section 428 of CrPC, the court added.
