Former BJYM president Barish Sharma released on bail

Former BJYM president Manoharmayum Barish Sharma was arrested in connection with a shooting incident at Kwakeithel Konjeng Leikai in Imphal West on October 14 night, in which five persons including a woman were injured.

The Session Judge, Imphal West on Monday released former BJYM president Barish Sharma on interim bail for a month from Monday, by furnishing a PR bond Rs 1 lakh, to facilitate his medical treatment.

The Session Judge, Imphal West on December 14 directed Manipur Sajiwa Jail SP for submitting a report of the medical facility inside the jail in connection with the bail application filed by Barish Sharma.

As per the report submitted by the SP of Manipur Sajiwa Jail, due to the present law and order situation in the state, the requisition for armed escort personnel cannot be done, while the accused could not be produced or admitted to the security ward as and when required. The medical facility of Manipur Central jail is not well equipped for investigation, the report mentioned.

The court observed that the accused was diagnosed with tachycardia, dyslipidemia and was planned for coronary angiogram as per Sky Hospital and his CTMT test could not be completed due to low back ache and inability to walk. The court further opined that on doing some research, it appears that the accused is exhibiting signs of heart disease and are prone to heart attack. And also, as per latest report from jail authority the accused was advised to get an MRI of the brain.

“Assuming a situation of heart attack arises, I am of the view that the jail authority may not be able to provide ample and timely intervention as per medical need of the accused. So, under guidance of the Supreme Court relevant laws, I find that granting some form of relief to the accused would secure proper and timely medical treatment of the accused, if need arises,” the court stated.

Therefore, the court released him on interim bail for one month with conditions that he should not abscond but present himself before the investigating officer of the case as and when summoned or before the court on every date fixed. He should not influence prosecution witnesses and he should not leave the state without permission of the court.
Additionally, he should submit a comprehensive medical report to the court on January 10, 2024.
