President of Manipur Pradesh Youth Congress Committee filed an anticipatory bail in connection with a FIR registered at Lamphelpat police station for an alleged attempt to murder members of Bharatiya Janata Yuva Morcha on February 9.
The Sessions Judge, Imphal West, on Monday directed OC Lamphelpat police station to submit a detailed report of the FIR case, returnable on or before February 16. The court will consider anticipatory bail of Manipur Pradesh Youth Congress Committee president, Ningthoujam Popilal, after the OC report.
Counsel of Popilal submitted that Popilal has reason to believe that he may be arrested on accusation of having committed a non-bailable offence at any time and the officer-in-charge of Lamphel PS has also served a notice to the petitioner directing to appear on February 11, in connection with FIR No. 32(2)2023 LPS.
Public prosecutor stated that Popilal has not disclosed the allegations levelled against him and as such, he has not approached this court with a clean hand. Hence, the prosecutor prayed for rejecting the prayer.
The court opined that there is no mention of any allegation levelled against the accused for which apprehension of arrest arises. Furthermore, the copy of the summon issued to the petitioner by the OC, Lamphel PS did not mention any specific section under which the petitioner has been summoned.
Hence, the court directed OC Lamphelpat police station to submit the detailed report of the case.
