POCSO Case: Teacher sentenced to 6-year-and-six-month rigorous imprisonment

The accused was convicted on April 19 for committing the crime.

Special Judge (POCSO) Fast Track Special Court Number 1, Manipur sentenced a private school teacher for penetrative sexual assault on child under POCSO Section 4, to undergo rigorous imprisonment for a period of six-year-and-six-month and directed to pay a fine of Rs 10, 000 on default of payment, to undergo simple imprisonment for three months.

The accused Khwairakpam Maheshwor alias Sanahal, 32, son of Kh Manihar of Nambol Khan Jiri Leikai, Imphal West was convicted on April 19 for committing the crime.

The court had reserved its judgment since the final hearing was conducted on February 19. Father of the victim filed a police complaint on March 25, 2016 at Bishnupur women police station, alleging that Maheshwar abducted his minor daughter.

An FIR was registered, based on the complaint and the investigating officer submitted the charge sheet to the trial court by framing charges against the accused under POCSO act after thorough investigation.

During the course of the investigation, the accused told the police that he took the girl to Churachandpur by bus on March 28, 2016. From there, he kept the girl in a hotel in Imphal and stayed there overnight. He again took her to Torbung and spent another night there before police arrested him the next day.

While declaring its verdict on the case, the court observed that the special public prosecutor had proved that the accused had carried out sexual crime against the victim under section 4 of POCSO act.

It may be mentioned that the court sentenced the convict for seven year rigorous imprisonment but the accused already underwent six months in custody. So, the six months were set off from seven years.
