POCSO Case: Manipur HC directs government for action against doctor for false report

In a case of sexual assault on a minor boy in Tengnoupal district on October 2022, a doctor at the subdivisional hospital, Moreh, Tengnoupal district had issued a false report to the effect that no injuries were found on the victim.

The Manipur High Court has directed the state government to take appropriate action against a doctor of a state government hospital for allegedly furnishing false reports in a sexual case involving a minor boy in Tengnoupal district.

In a case of sexual assault on a minor boy in Tengnoupal district on October 2022, a doctor at the subdivisional hospital, Moreh, Tengnoupal district had allegedly issued a false report to the effect that no injuries were found on the victim.

His report is belied by the subsequent report of November 23, 2022 of the Department of Forensic Medicine, JN Institute of Medical Sciences, Porompat, Imphal East, which clearly indicated that there were signs of sexual violence committed upon the child, the court stated.

It was found from an affidavit filed before the Manipur High Court regarding a suo-moto case in connection with the alleged rape of a minor boy in Tengnoupal district.

The HC stated that the doctor, who tried to cover up the crime under the POCSO Act, cannot be let off lightly.

Additional advocate general, Manipur, stated that none of the arrayed respondents of the case would be in a position to take action against the doctor, so it will be appropriate to implead the additional chief secretary (Health), government of Manipur, as respondent in the case.

The HC on Wednesday gave a last opportunity to the state government to prove bona-fides with regard to implementation of the POCSO Act, 2012, by taking appropriate action against the doctor who ostensibly furnished a false report to aid and abet the accused in the case under the POCSO Act 2012.
