Fund Misuse Case: MSPCL employee released on bail

Special Judge (Lokayukta), Manipur on Friday released Aribam Rajendra Sharma and O Yaiskul Singh by considering the position and status of the accused persons, stating that they are not likely to abscond from the case.

Two persons who were arrested in a fund misappropriation case, including an employee of the Manipur State Power Company Limited (MSPCL), have been released on bail on furnishing PR Bond of Rs 1,00,000 each with one surety each of the like amount.

Special Judge (Lokayukta), Manipur on Friday released Aribam Rajendra Sharma and O Yaiskul Singh by considering the position and status of the accused persons, stating that they are not likely to abscond from the case.

As clearly submitted by the Prosecution, there is no specific financial gain in respect of the accused persons showing that reasonable prima facie is not made out as against the two acccused persons regarding personal financial benefits. Tampering of witnesses is also not likely, the court stated.

Both the accused persons were produced before the court after completion of police custody remand with a prayer for judicial custody remand till April 22, 2022. 

The court also heard the bail applications filed by the two accused.

The court heard the submission of Special PP and senior counsel of the accused persons. After hearing the submission, the court found that both the accused persons committed some irregularities in the maintenance of official documents and official procedure, but according to them, it is on the direction of the then Executive Engineer.

So far, the investigation could not unearth the exact financial gain of the accused persons and in fact, there is no mention in this regard in the remand prayer too. It is also seen from the medical papers produced by the IO that both the accused persons were produced before the concerned Medical Authority who advised them to follow up for further medical treatment.

While releasing them, the court made conditions that both the accused persons shall appear before the IO every day starting from April 09, 2022 between 10:00 a.m. to 12:00 p.m. or till their appearance is excused or relaxed by the IO; they shall not leave the state of Manipur without the permission of the court; they shall not influence Prosecution witness(s); they shall appear before the court or any competent authority as and when directed.

It is worth noting that the FIR was registered at Crime Branch Police Station, CID Crime Branch Manipur on the basis of direction/recommendation of the Manipur Lokayukta’s order on February 7, 2022 passed in Complaint Case No. 02/2020 of Manipur Lokayukta by the complainant, Thongthang Manlun, MPS.

An Inquiry Report in the same case has also been submitted. The case pertains to Embezzlement of huge amount of public money from the fund for the project i.e. construction of 2x1MVA sub-station at Chakpi Karong along with associated 33 kV line (for 45 Kms) and related civil work on Turn-Key basis by causing major changes to the project in an unauthorized manner and also by doing illegal activities in the name of executing the project.
