Court rejects sexual offence accused bail pleaIMPHAL | Sep 16
Special Judge POCSO, Imphal West rejected the bail prayer of the accused who has been charged of committing penetrative sexual assault to a minor girl, and sent to judicial custody till September 27.
Complaint was raised against the accused, Rajkumar Milan alias Nanao, 33, son of (L) RK Amusana of Leiphrakpam Makha Leikai to Wangoi PS six months after the incident took place on March. The minor victim revealed the incident to her mother on August. As soon as her mother confirmed the story, she lodged the complaint to Wangoi PS.
The complaint lodged on August 9, 2019 stated that the accused had forcibly committed penetrative sexual assault to her daughter near Laiphrakpam paddy field canal. The culprit threatened the victim with dire consequences and she had been remaining silent until she disclosed the incident to the complainant (her mother) on August 9, 2019.
After registering the FIR, the police went to arrest the accused. However, he was found absent in his house. On September 8, the accused was arrested and remanded into police custody.
After completion of police custody, the accused was produced before the court with prayer of judicial custody till September 28. Bail prayer was filed before the court from counsel of the accused.
The accused counsel submitted a bail prayer that the accused is innocent and has falsely been implicated on the case. The counsel also argued that the age of victim is yet to be ascertained, so as to attract the offence under POCSO.
While Special PP submitted that delay of FIR has been properly explained before the court and the birth certificate of the victim has also been obtained. It was submitted that if the accused has been released on bail, there is possibility of hampering evidence. Thus, it was prayed for judicial custody remand and rejection of the bail prayer.
The court after perusal of the materials and hearing both the counsels, sent the accused to judicial custody till September 27 with a satisfaction of accusation levelled against the accused under section 29 of POCSO.
It may be mentioned that the accused on interrogation by police, has admitted the charge levelled against him.
