Charges framed against four personnel in connection to fake encounter case

Special Judge (SIT), Imphal East has framed charges against four CDO personnel under section 120-B/201/302r/w IPC in connection to the extra judicial execution of Soram Ranjit in 2008.
The four personnel have been identified as head constable, Md. Shaukat Ali, constable, Thiyam Brojen, constable, Md Wahajuddin and ASI, Md. Anwar Hussain.
The charge under section 201IPC is framed against accused Md. Anwar Hussain are on a separate sheet is appended.
The court made the announcement in an open court, after asking to plead guilty or not to accused persons. The four accused plead not guilty and claim to be tried.
The case investigation was started after CBI took charge of investigation with direction from Supreme Court in 2017.
Charges were framed against the four personnel with submission from special PP of CBI. The submission mentioned that the deceased, Soram Ranjit was married and staying at Khurai. He was doing business of betel leaves between Kangpokpi to Imphal, it said. On February 15, 2008 at around 5pm, Ranjit was called by one Anthony who was an informer, it added.
The CDO team were doing their duty on Hatta Minuthong road led by Md. Shaukat Ali. Anthony told them that one person with arms and ammunition was coming towards Golapati, it further said adding upon receiving the information, the CDO team rushed towards the river side and took positions. Instead of stopping Ranjjit, they started firing towards him, it said.
Afterwards, when they searched the area, they found that a bullet ridden body was lying there and in turn, the police team led by Md. Anwar Hussain came to spot and took the body at RIMS morgue, it said.
It was mentioned that the firearms recovered from the body was not in a working condition due to defective firing mechanism and magazines as per the FSL report. Questions were raised how deceased had opened fire from the defective weapon, it said.
It was further mentioned that Md. Anwar Hussain ASI of Porompat PS as first IO of the case was supposed to take such serious offence and failed to take some of the essential steps of investigation. All lapses seemed to be an intentional attempt to help the accused CDO’s team, it added.
They created a false story of encounter with unknown extremists to screen themselves from the offence committed by them, it was submitted and prayed for framing charges against them.
On other hand, accused persons’ counsel submitted that on fateful day through specific information about presence of some armed and underground cadres in and around at Hafiz Hatta area frisking and checking was conducted.
After 20 to 30 minutes 2 - 3 persons were seen coming from Golapati side. It was submitted that The accused persons were asked to stop but instead of stopping, one of them fired towards the CDO team and the accused persons retaliated immediately and one person was shot dead at the spot.
The rest escaped by taking advantages of darkness, it added.
Counsel of the accused further submitted that after the encounter, the area was thoroughly searched and one dead body was found with one 9mm pistol, three empty cases, one live round near the body.
A letter signed by one Paoboy and one mobile phone handset Motorola Model CE-O 168 were found. Soram Ranjit died on the encounter that took place between them, it was submitted. There is no prima facie evidence against the accuse persons for framing charges against them, it was submitted and further prayed for discharging.
The court after perusal of the materials and submission from counsel came to conclusion that there are sufficient evidence or grave suspicion against the accuse persons for their involvement to the charge levelled against them. And the court ordered the charge to frame against the four accused.
