‘Pandey does not have power to appoint pro VC during his force leave’
IMPHAL | Sept 22 : “As per the leave rule of the government of India, a person who is in force leave cannot exercise the power of his service. So appointing a pro vice-chancellor by A.P. Pandey during his leave for enquiry is null and void,” said former vice-chancellor, Ng. Bijoy.
Speaking to IFP, he said that if the leave of Pandey is a casual leave, he has the power to appoint a pro vice-chancellor, but in this case Pandey is in force leave so he does not have the right to exercise his power.
Regarding the force entry to vice-chancellor office yesterday by Yugindro, the former vice-chancellor said that such act is against the on-going inquiry. The only person who is permitted to enter the office of vice-chancellor during inquiry period is the nodal officer, he added.
He continued that according to the office memorandum of the Manipur University signed by registrar (in-charge), M. Shyamkesho it stated that Pandey will be on leave during his inquiry period as per the memorandum of agreement (MoA) signed on August 16 which has been approved by ministry of HRD.
It also mentioned that the order issued in suppression of the order dated on August 20 signed by registrar (in-charge), Sh. Dorendrajit stated that Pandey will be on leave during the inquiry period and until follow up action taken on the inquiry report by the competence authority preferably within a period of 15 days which is included in the clause D of the MoA, he added.
As per the advice of the HRD ministry dated August 2, Pandey have been granted a leave for a period of 20 days on the same day.
On MU office order dated August 30, signed by registrar (in-charge), Dorendrajit with the advice of MU chancellor, Dilip Nachane, it stated that the leave of Pandey has been extended till the completion of the enquiry and follow up action to be taken up on the inquiry report.
All the documents have clearly proved that the pro vice-chancellor appointed by Pandey is unofficial so there is no pro vice-chancellor of the university. Accordingly, the post of the vice-chancellor (in-charge) should be given to the senior most professor, W. Vishwanath as per the MU Act 2005, said Bijoy.
He lambasted the state government for the immature and violence act taken up by security personally in the hostels of the university against the students during the intervening mid-night of September 20 and September 21.
If police wanted to raid the hostels they have to take the permission of the warden and have to enter along with the warden, he added.
Firing of tear gas shell inside the hostel is a heinous act, they might have conducted the raid calmly if they wanted to as the hostellers are ‘unarmed students’ not a criminal or armed groups, continued the former vice-chancellor.
