Submit detail medical report of BJYM members Suresh and Alex: Court

The investigation officer has been told to submit a detailed medical report of BJYM members Mayanglambam Suresh and Ningombam Alex in connection with the FIR against Ningthoujam Popilal for attempted murder of BJYM members.

The Session Judge, Imphal West on Friday directed the investigation officer to submit a detailed medical report of BJYM members Mayanglambam Suresh and Ningombam Alex in connection with the FIR against Ningthoujam Popilal for attempted murder of BJYM members.

During the bail objection hearing of Popilal, the IO stated that the statements of the victims, M Suresh and N Alex, could not be recorded as they are in ICU.

While the court opined that the IO reporting that examination of Popilal revealed an altogether contrasting story compared to the allegations of the FIR case, which is in support of the submissions of Popilal's counsel, the counsel of Popilal submitted that Popilal has been falsely implicated, that the FIR has been filed by the alleged victim and workers of BJYM to counter the complaint filed by Popilal in connection with an incident on February 8, in which Popilal was assaulted by N Alex Singh, BJYM Office Secretary and 30 other associates.

However, PP submitted that the victims of the FIR are presently in ICU at Raj Medicity while materials so far in the record clearly implicate Popilal. Therefore, the PP prayed for rejecting the prayers of Popilal.

The court, after considering the submission, opined that further proceeding and/or disposal of the bail application would only be justified after getting a clearer picture of the true facts of the case, which, unfortunately cannot be obtained unless the victims of the FIR are examined.

Situated thus, in order to ease the conundrum created by the situation, the IO of the case is directed to place a detailed and complete medical report with regards to the medical treatment given to Mayanglambam Suresh Singh, aged about 35 years, son of M Olin Singh of Kakching Khunou Hijam Maning Leikai and Ningombam Alex Singh, aged about 28 years, son of N Ajitkumar Singh of Brahmapur Lalji Lakpa Leikai, as well as their present medical condition (including the information as to whether they are still under treatment or discharged; injury(ies) sustained etc.), the court stated.

It may be mentioned that Manipur Pradesh Youth Congress Committee (MPYCC) president Ningthoujam Popilal had been granted interim anticipatory bail in connection with the FIR registered against him at Lamphel Police Station.

The FIR was registered based on a complaint lodged by Manoharmayum Barish Sharma, the then president of BJYM (Bharatiya Janata Yuva Morcha) against Ningthoujam Popilal and three other unknown persons under Section 307/326/34 IPC and 25(1-b) Arms Act.

The complaint alleged that on the night of February 9, N Popilal pointed a gun at M Suresh, spokesperson of BJP Manipur Pradesh and Alex Ningombam, office secretary BJYM and assaulted them with the intention to kill before fleeing the scene with three unknown persons.
