Rape Case: Court grants interim bail to two women lecturers

The counsel said the two women lecturers at Saina Institute of Medical Science (SIMS), Porompat were falsely implicated in an FIR registered under Lamphelpat Women Police Station regarding kidnap and rape by the founder of the institute.

The Session Judge, Imphal West on Saturday granted interim pre-arrest bail of two women lecturers in connection with the kidnapping and rape FIR case on furnishing PR bond of Rs 20,000 with one surety each of the like amount.

The two lecturers, Sonia Yambem, Yambem Nonibala Chanu, aged about 29 years, of Bamon Kampu Yambem Leikai, Imphal East district and Laishram Kunjarani Devi, aged about 28 years, of Top Khongmakhong, Imphal East district approached the court for granting pre-arrest bail on August 20.

According to the counsel, the two women lecturers at Saina Institute of Medical Science (SIMS), Porompat were falsely implicated in the FIR registered under Lamphelpat Women Police Station regarding kidnap and rape by the founder of SIMS, Porompat, Imphal East, Manipur, namely Yumnam Surjitkumar of Porompat, Imphal East district, at the residence of Md Wajiv at Sekmaijing.

The counsel submitted before the court that on August 18, at about 2:30 pm, while the lecturers were out of their residences, a team of Women Police Station, Imphal West came to their residences and tried to arrest them.

The counsel also submitted that when the family members inquired about the matter, the police personnel said that an FIR has been registered against them. It is also submitted that they have never committed any offence and all the charges are false but they have apprehension that they might be arrested by the police personnel of WPS IW on false allegations and thus pray for granting the prayer.

The court after considering the facts submitted by the lecturers in their application opined that the matter will be considered after a detailed report is received from the concerned OC. Hence, the concerned OC has been directed to furnish a detailed report regarding the FIR matter.

In the meantime, the lecturers were granted interim pre-arrest bail in connection with the FIR case. And the court directed that in the event of arrest, in connection with the FIR, the lecturers shall be released on interim bail on furnishing PR bond of Rs 20,000 with one surety, each of the like amount on the conditions that they shall cooperate with the investigation, they shall make available before the investigating authority, they shall not influence prosecution witnesses and they shall not leave the state of Manipur without prior permission of the court.

The court fixed August 24 for a report from Women PS OC and hearing.

It may be mentioned that the two lecturers are accused in an FIR case lodged by a victim, who is also a student of Saina Institute of Medical Science (in short SIMS), Porompat, Imphal East where the student alleged that she was kidnapped and raped by one Yumnam Surjitkumar, of Porompat, Imphal East District, Manipur, the founder of Saina Institute of Medical Science (SIMS), Porompat, Imphal East, at the residence of Md Wajiv of Sekmaijing on August 14 and it was reported on August 16 at 5:00 pm at Lamphel Women PS. 

Hence, the case was registered under FIR case of WPS-IW PS, under Section 366/ 376/ 417/120-B/34 IPC.

With great apprehension of the grievance that they may be arrested any time on the false accusation of having committed non-bailable offence or offences by the police of Women Police Station, Imphal West with an object of injuring or humiliating, the two women lecturers prayed for anticipatory bail.
