MSCW welcomes Manipur High Court judgment

The MSCW stated that no section of the society should give any kind of trouble in the functioning of the commission that would lead to delay in delivering justice.

The Manipur State Commission for Women (MSCW) on Friday welcomed the February 18 judgment of the Manipur High Court in connection with the petition filed against MSCW, while it appealed against any interference in the functioning or proceeding of cases taken under the MSCW.

During a press conference at the MSCW office on Friday, its chairperson in-charge, Thumlip Tiningpham Monsang said a writ petition was filed against MSCW in relation with complaint case 26 of 2019 initiated by the commission.

The complaint was made by a 23-year-old girl on the ground of being cheated by her partner with the promise to get married, she said.

She said that the respondent of the case with his parents had filed a petition against the MSCW in the High Court of Manipur by charging that MSCW transgressed its authority given under MSCW Act 2006.

The petitioners challenged the power and function of the commission by levelling wrong allegations and without knowing any fact of the commission, Monsang said.

Although the petitioners sought to quash the complaint filed in the commission, the Manipur High Court on February 18 declared that the petition was devoid of merits and dismissed the case, she added and termed it a landmark judgment.

“The High Court also observed that the commission has power of civil court as provided under clause (2) of section 10 of the act and in view of the above, the High Court of Manipur is not inclined to quash the proceedings of the complaint case 26 of 2019 which is pending before the commission. The court also ordered that the petitioners have to face the inquiry initiated by the commission and gave its opinion that the commission has not done anything beyond the scope of the MSCW act 2006 as alleged by the petitioners,” she said.

While appealing against causing any kind of hindrances in the working of the commission, she said that if the petitioners didn’t file the petition, the case would have already been settled and justice delivered for the victim.

The Commission is being set up to look after the grievances of the women community. As such any section of the society should not give any kind of trouble in the functioning of the commission that would lead to delay in delivering justice, she added.
