Manipur HC orders Speaker to settle disqualification case against JDU MLAs

Five MLAs from JD(U) namely Khumukcham Joykishan, Ngursanglur Sanate, Mohammed Ashab Uddin, Thangjam Arunkumar and LM Khaute had joined the ruling BJP party.

The double bench of chief justice Siddharth Mridul and justice Golmei Gaiphulshillu of the Manipur High Court on Monday ordered Manipur Legislative Assembly speaker to settle disqualification case against JDU MLAs, who defected and joined the BJP.

Janata Dal (United) secretary general Maisnam Dorendro filed a petition in the HC seeking issuance of writ of mandamus directing the speaker to register and decide the disqualification case filed on January 11, 2023 under Article 191(2) and paragraph 2(1)(a) of Tenth Schedule of Indian Constitition.

It should be mentioned that five out of the six MLAs from JD(U) had joined the ruling BJP party. Those who joined BJP are Khumukcham Joykishan, Ngursanglur Sanate, Mohammed Ashab Uddin, Thangjam Arunkumar and LM Khaute.

During the hearing, counsel of the petitioner argued for immediate disqualification of the defected MLAs.

Advocate general Lenin Hijam submitted with reference paragraph of the SC decision in a case, affirming that the speaker will address the disqualification petition within a reasonable period as per law.

The HC accepted assurance and ordered to adjudicate the disqualification case.
