Manipur HC directs MU to issue fresh list of candidates for curator posts

The high court also directed Manipur University to cancel or recall a corrigendum that notified that the list of 12 short-listed candidates stood superseded.

A single bench of the High Court of Manipur justice Kh Nobin on Thursday directed Manipur University to issue a fresh list of short-listed candidates for the post of Curator for interview within a period of three weeks.

The high court also directed Manipur University to cancel or recall a corrigendum that notified that the list of 12 short-listed candidates stood superseded and that only Indra Vats and Laishram Sadhana Devi were short-listed for the interview to be held on January 23, 2020.

The interview of any candidate out of a total of 12 candidates short-listed earlier, is found to be ineligible for the interview, the reason thereof ought to be made known to him or her, the HC order added.

The High Court declares that the holding of the post of the Guide Lecturer by Laishram Sadhana Devi at Manipur State Museum, department of Arts and Culture in violation of the provisions of the Recruitment Rules, 1981 by the government order of November 29, 2016, after her contractual engagement being regularised, is illegal, null and void and consequently, the government order holding post stands quashed.

The HC has passed judgment on a petition filed by the assistant Curator of Manipur University, Ratna Mutum. It was filed against Commissioner (Arts & Culture), Directorate of Arts and Culture; Director (Arts & Culture), Directorate of Arts & Culture; Curator, Manipur State Museum; Manipur University; Laishram Sadhana Devi, guide lecture MU.

The petitioner alleged that L Sadhana Devi was not eligible for appointment to the post of the Guide Lecturer, Manipur State Museum as she had already become age-barred under the provision of recruitment rules, 1981. The State officials with a view to getting personal gains and in an illegal manner chose to indirectly accommodate L Sadhana Devi to the post of the Guide Lecturer engaging her in the Arts and Culture department by executing an agreement for engagement on contract basis between the government of Manipur represented by the director of Arts and Culture.

Further, the petitioner stated that Manipur University invited an applicant for Curator post on August 3, 2017. The petitioner and L Sadhana Devi also applied for the Curator post and MU had shortlisted 12 eligible candidates for the post but did not fix the interview date.

All of a sudden, Manipur University issued an undated corrigendum allegedly signed on January 8, 2020, notifying that the earlier list of 12 candidates stood superseded and accordingly, Indra Vats and L Sadhana Devi were shortlisted for the interview to be held on January 23, 2020, at 01:00 pm. The aforesaid corrigendum did not mention any reason as to why the names of 10 applicants including that of the petitioner had been removed by the Manipur University.
