Manipur: Bishnupur district magistrate bans use, sale of firecrackers

District magistrate Ranjan Yumnam issued an order on Sunday stating that there is apprehension of breach of peace and public tranquility if the sale and use of crackers during the ensuing Diwali is not checked.

The district magistrate Bishnupur district Ranjan Yumnam has issued a prohibition on the use of firecrackers during the celebration of the coming Diwali festival as well as possession and sale of crackers and fireworks in the whole area of the district with immediate effect until further orders.

Ranjan Yumnam issued an order on Sunday, stating that there is apprehension of breach of peace and public tranquility if the sale and use of crackers during the ensuing Diwali is not checked.  

The order stated that no person, persons or entity, firm by whatever name known, should engage in possession and sale of crackers and fireworks without a valid license issued by the district magistrate under Section 84 of the Explosives Rules, 2008.

Since the district magistrate has not issued any temporary license for possession and sale of crackers and fireworks on date in connection with the ensuing Diwali festival, any case of possession and sale of such items are in violation of the Explosives Act, 1884 and the rules thereunder and action as per law will be taken against such violators, it added

There is a prevailing insurgency in the state and possibility of misuse of crackers by various vested interests with a view to cause annoyance or panic or confusion amongst the public, or even to divert security forces as a result of such mischief or confusion with a view to cause injury or loss of lives and property elsewhere, it mentioned.

It is considered that prohibiting the use of crackers and fireworks is likely to cause breach of peace, disturbances to public tranquility and danger to human lives and properties, arising out of anticipated misuse of crackers and fireworks as stated above, it added

It observed that since Diwali festival falls on November 4, it is not possible to identify all persons who are likely to cause such mischief or misuse of crackers or fireworks within the short time available. Therefore there is an emergency, and it is considered a fit case for taking up proceedings under Section 144 Cr. P.C. 1973, the order added. The order further stated the prohibition is directed to the public in general.
