Man convicted for raping 10-year-old girl in Churachandpur

The investigating officer of the case found that the accused is an uncle of the minor who stayed with him in the same house.

Special Judge, POCSO, Churachandpur, Manipur on Tuesday convicted a 41-year-old man under section 4 of POCSO Act on charges of sexual assault on a 10-year-old girl in 2016.

Member of district council, ADC CT Lian Guite on October 15, 2016 filed a complaint to the officer-in-charge, Women Police Station, Churachandpur district that the minor was raped on October 14, 2016 at Ngathel cemetery in Churachandpur by unknown persons.

The investigating officer of the case found that the accused is an uncle of the minor who stayed with him in the same house.

They stated that the minor was raped by her uncle at their residence when her other family members were all out for work, by taking advantage of the situation. It was also found that the accused had instructed the victim to lie that she had been raped by some unknown persons at the cemetery at New Lamka.

The investigating officer of the case filed the charge sheet against the accused before the court and framed charges against the accused for having committed the offences punishable under section 376 IPC and Section 4 and 8 of POCSO Act on March 29, 2019 to which he pleaded not guilty, and claimed trial.

The court agreed with the Special Public Prosecutor of the state that the statements of the victim before the court was completely sufficient to hold the accused of the offence for which he has been charged in the case. The court further observed that the victim is absolutely trustworthy and a witness. In cases like the present one, the testimony of the prosecutrix alone is material to bring the guilt of the accused, the court stated.

The court observed that there is sufficient evidence to hold the accused guilty of the offence charged under section 4 of the POCSO Act. With these observations, the court convicted the accused under section 4 POCSO Act, 2012 for committing sexual assault, and fixed November 18 for sentence hearing.
