HC okays All Manipur Bar Association election

The Manipur High Court had quashed and set aside the notice issued by the returning officer of AMBA on April 25, 2022 that allowed the nomination of outgoing president of AMBA.

Manipur High Court on Wednesday directed the returning officer of AMBA to proceed with the election of the office bearers of All Manipur Bar Association (AMBA).

Earlier on May 7, Manipur High Court justice Ahanthem Bimol had directed not to hold the election of the executive members of All Manipur Bar Association (AMBA) for the year 2022-2024 without the leave of the high court.

The High Court had quashed and set aside the notice issued by the returning officer of AMBA on April 25, 2022 that allowed the nomination of outgoing president of AMBA.

The move came after a petition was filed by an advocate Puyam Tomcha Meetei who alleged that the outgoing president Maibam Nilachandra who submitted nomination was not eligible for re-election under the bye-law of AMBA. 

Following the petition, the HC directed the Registrar of Societies to decide as to whether the outgoing president is eligible for re-election as president of AMBA in view of the provision under Bye-Law 13(II) first proviso.

The Registrar of Societies, Manipur submitted that outgoing president Maibam Nilachandra is not eligible for re-election as the president of AMBA and that his nomination for election to the post of president may be rejected on May 9.

The HC stated that the Registrar of Societies is the competent authority to decide any doubts as to the meaning of any provisions of the Bye-Law of AMBA as provided under Rule 47 of the Bye-Law of AMBA. The HC observed that as the Registrar has decided the dispute about the eligibility of the outgoing president; it has considered that there is no need for re-deciding the issue by the High Court. 

Hence, the HC issued the direction to proceed with the election of office bearers of AMBA.
