Babysana Death: CBI reopens case for further investigation

The CBI filed an application for returning original documents, articles, and statements recorded under section 161 CrPC.

The Central Bureau of Investigation (CBI) has reopened the Babysana death case for further investigation as the Chief Judicial Magistrate, Imphal West rejected the closure report submitted by the CBI.

Following the court’s direction, the CBI filed an application for returning original documents, articles, and statements recorded under section 161 CrPC. The original documents, articles and statements recorded were submitted before the court while submitting the final report.

The court accepted the prayer of the CBI and allowed the documents to be returned to the IO to assist in the re-investigation of the case.

While rejecting the closure report, the court directed the investigating officer of the case to find out the blood group of the deceased, N Babysana Chanu and to complete her DNA profile by using samples obtained from her. It directed to find out the matching blood group and the DNA profile, if any, either of the deceased or the accused persons.

The court also directed the CBI to find out the blood group of her biological father and mother in addition to the blood group of all the accused persons and complete their DNA profiles for reinvestigation.

Earlier, Ningthoujam Tomchou Singh, the father of late Babysana, objected the final report asserting that his daughter was found murdered at the accused Ph Landhoni's illegally run boarding at Canchipur, Imphal. An FIR No. 138(7)2019 SJM PS was lodged against the accused persons and the Manipur Police had made prior police investigations and they had proved that the said accused had run the boarding illegally by not registering under JJ Act as such section 420 of IPC and violation of JJ Act, he stated.

Not satisfied with the investigation carried out by Manipur Police, the victim's father had filed a Criminal Petition for CBI investigation which was allowed by the High Court of Manipur by a Judgment Order of November 11, 2019.

A 13-year-old Babysana of Thangmeiband Imphal West, a hosteler of Standard Robert School, Chanchipur Imphal, was found hanging inside the hostel on July 18, 2019. Her death sparked controversy with family suspecting foul play in the girl’s death though post mortem suggests the cause of death due to asphyxia by hanging.

The JAC formed in the case had launched a series of agitation, including shutdowns, demanding the arrest of culprits involved in the alleged murder, bringing the state to a standstill on several occasions. The agitation stopped only after the Government assured CBI inquiry into the incident.
