After over 5 long years, the Chief Judicial Magistrate, Imphal West, Manipur on Thursday (November 28) closed the Babysana case and set free all alleged accused, including school authority, as no evidence came up against them for having common intention to murder or abetment of suicide of Babysana Chanu or was cruel to the child or had cheated any person.
Babysana, a 13-year-old student at Standard Robarth Higher Secondary School in Imphal West, was found hanging in her hostel dormitory on July 18, 2019.
The victim’s father had filed a petition for a CBI investigation after the Manipur Police’s investigation was not satisfactory. The victim’s family and others protested the death, demanding the arrest of the culprits. The agitation ended after the government agreed to a CBI inquiry.
CBI has submitted its final report, which states that Babysana committed suicide by hanging in 2019. The CBI also stated that no evidence was found to support the allegation that the school authorities or others were involved in her death.
The CBI’s final report stated that Babysana was not subjected to physical or mental torture, and that the school authorities did not admit students who were not eligible to stay in the hostels.
The cril misc FR case was filed in connection with the final report submitted by the CBI in connection with the controversial death of N Babysana on July 18, 2019 inside the hostel of Standard Robarth Higher Secondary School, Canchipur before the same Court in May 2021.
The CBI even stated in the final report that the chargesheet could not be submitted against the accused persons as no evidence emerged during investigation which could implicate them.
In March of 2022, the CBI reopened the case after CJM Imphal West rejected its final report.
Although Ningthoujam Tomcha and his counsel were present at the Court, none from the side of CBI Special Crime Branch, Kolkata was present for the hearing.
During the proceeding, the court observed that the possibility of murder of N Babysana Chanu is not proven and the allegation under Section 75 of JJ Act could not be proven against any persons. The allegation of abetment of suicide on the school authorities and the warden U/s 305 1PC could not be proven either and the allegation of cheating by the school authorities with parents and children could not be proven too.
Further, in connection with blood samples of the alleged accused, itstated that the genetic profile of the deceased girl does not match with the genetic profile of alleged accused persons namely, head warden Ileen Kamei, D/o (L) Kamei Kumar of Langthabal Chingthak, then Warden Nongmaithem Jinnty, D/o Joykumar of Moirangkhom Sougaijam Leirak, then Junior Administrator Pheiroijam Robinson, S/o Ibohal of Canchipur near MU Gate, founder cum Principal Pheirojam Landhoni and coordinator Pheiroijam Romita, W/o Raja of Kwakeithel Thiyam Leikai.
“No such human semen could be detected in panty of deceased girl”, the laboratory report stated.
Therefore, the court stated that there is no allegation against the accused person as per the petition except alleging the investigating authority and regarding that the sample were made useless by deliberate delay and unscientific mixing and no blood group of the accused identified thereat, which has already been answered as per the statement of the expert that the laboratory procedure which has to be done to find out, the court stated.
Hence, the court rejected the protest petitions filed by the victim’s father and the final report of the CBI was accepted.
The CBI’s final report concluded that Babysana committed suicide and that there was no evidence supporting the allegations of foul play.
