Administrator tribunal stays transfer order of IFS officer

Tribunals says frequent transfer not permissible under law.

Central Administrator Tribunal, Guwahati on Wednesday stayed the transfer order of one N Ganesh, IFS from DFO, Chandel to DFO, Soil, and Water Conservation, Division-1, on the ground that the officer has been subjected to frequent transfer.

N Ganesh after being selected as Indian Forest Service (IFS), was appointed as assistant conservator of Forest, Manipur on May, 22, 2017.

Aggrieved by the frequent transfer order, the officer filed a petition for setting aside and quashing the government order of January 27, 2021 by which the officer is sought to be transferred from DFO, Chandel to DFO, Soil and Conservation, Division-1.

Central Administrator Tribunal, Guwahati heard the petition and stayed the transfer order stating that the officer has already been subjected to frequent transfer. As per the decision of Apex Court, the decision of the Tribunal as well as per law of land, frequent transfer shall not be permissible under the law.

It stated that it is a prima facie case fit to entertain by the court. Otherwise, the officer may face irreparable loss. As such, the court stayed the transfer order and allowed him to render his service at the present place of posting in Chandel Forest Division till March 11, 2021.

As per the petition, after being appointed as assistant conservator of Forest, Manipur on May 22, 2017, he was transferred to Climate Change, Biodiversity and Medical on January 25, 2018. He was again transferred to Thoubal, Forest Division as in-charge DFO on July 4, 2018. On September, 25, 2018 again he was transferred to the Bishnupur forest division and after two months of his service at Bishnupur, he was transferred to DCF (planning and coordination) on February 21, 2019. Further, on September 13, 2019, he was transferred to DFO, Churachandpur forest division.

On June 12, 2020, again he was transferred to DFO, Chandel forest division. Now, on January 27, 2021, he was sought to be transferred from DFO, Chandel to DFO, Soil, and Water Conservation, Division-1.

The tribunal court by staying the transfer order till the next hearing March 11, 2021, issued a notice of returnable to respondents within four weeks.
