Chief Judicial Magistrate, Imphal West has rejected the bail application filed by murder suspect Naorem Dijamani after bail hearing, today.
Naorem Dijamani, presently lodged at Sajiwa jail Manipur as a prime suspect in murder of his wife Naorem Rekha on May 29, has filed application on health grounds twice at the court. Today, after the bail hearing, the court rejected the bail application with the observation that the Dijamani’s health issues should be manageable from the jail. And the section charged against him is serious offence that does not allow the accused to get bail.
The court heard the submission of both parties. The bail petitioner was represented by his counsel. The bail objection report was already submitted by IO of the case along with the case record. The medical reports submitted by SP Manipur Central jail was analyzed by the court.
Counsel of the petitioner submitted that the accused is an old but respectable member of the society having no criminal records. The accused is innocent of the allegation, it said. On the fateful date, he was in his office and was informed of the incident. He came home to find the deceased already dead and lying in a pool of blood. Being shocked, he took out a cloth placed it below the head of the deceased which caused the blood lying around to splatter on his pants.
It is also submitted that a sum of Rs. 4,00,000 were stolen from the purse of the deceased. Some gold ornaments were found missing from the body of the deceased, it said. All the materials clearly show that the accused is not involved in the offence of the case, it added. It is also further submitted that the deceased is always at home alone during daytime and accused used to come home only after 4.30 pm.
It is submitted that the accused is already in police custody and judicial custody for 49 days is now complete and further remand is no longer required as investigation in his respect is completed. Further, it is submitted that accused is seriously ill with high blood pressure and sugar.
The additional public prosecutor submitted that the sufficient circumstantial evidence exist which prima facie made out the case against the accused person. Hence on merit, the accused cannot be released on bail at this stage when the investigation is going on steadily.
The prosecution materials such as seized items, statement record under section 161 Cr. PC and report of forensic science laboratory, Pangei and mobile forensic tracer clearly showed there are materials for further investigation. At this stage, no new materials are found that can make to form any opinion. In fact, no direct materials exist to implicate the present accused person but the materials as available are in needs of further investigation.
And as regards to the submission of the commission of the theft in the house of the deceased, the same appears to be investigated by the IO of the case. The offence charged is one of murder which is serious and grave.
The court directed SP-Sajiwa jail to continue the arrangement and treatment of accused person for his entire ailment at all facilities available and give the necessary medications regularly.
Mentioned may be made that IO of the case had mentioned that there are ample evidence to believe that he might have committed the crime before he left for the office and then concocted a story. As per the post mortem analysis and the crime scene report about the nature of the injuries, there is a probability that the weapon used in the crime is the blood stained metallic incense stick stand recovered from the ground floor of the residence.
Dijamani himself lodged a written complaint to Singjamei PS claiming that on May 29 day between 11.30 to 12.30 pm his wife, Thokchom (N) Naorem (O) Rekha was killed by some unknown persons while she was alone at home. That time he was at his office at District Consumer Redressal Forum, Sangaiprou.
