10 cops charge-sheeted in fake encounter caseIMPHAL| Jan 11
Charge sheets were submitted against 10 police personnel including a then subedar of 3rd IRB, to the chief judicial magistrate, Imphal West by the Special Investigation Team (SIT) of the CBI, New Delhi in connection with an alleged fake encounter case that took place during 2009.
This is the eighth charge sheet filed by the SIT after it was constituted by the agency in compliance to an order of the Supreme Court issued on July 14, 2017 to probe into the alleged extra judicial executions numbering 1528 cases perpetrated by the army, paramilitary forces and Manipur police in the state.
The then subedar is identified as Irengbam Khaba Singh; and the other police personnel are identified as then head constable, H. Premjit Singh, then constables, Yengkhom Ibomcha Singh, Pebam Sanayaima Singh, Soibam Premjit Singh, Oinam Inaoton Singh, P. Ibomcha Singh, Mayanglambam Chitrajit Meitei, Laishram Naba Singh and havildar, Laishram Premkumar.
The charge sheet was submitted against them under section121/121-A/307, 34 IPC and 25(I-C) Arms Act after completion of the investigation of the alleged fake encounter case that took place in the night of September 8, 2009 at Awang Khunou along NH-53 under Patsoi police station which killed six individuals.
The six deceased are identified as Kshetrimayum Govind Singh of Keishamthong Hodam Leirak, Ngasepam Danny Singh of Sega Road Khwairakpam Leikai, Md. Tomba of Mayang Imphal Konchak, Ahongbam Oken Singh of Langol Ningthou Leimakhun, Md. Mujibur Rehman of Uchiwa Wangbal and Md. Ajgar Ali of Borbetta road, Assam.
The investigation report of the CBI claimed that Govind was engaged in the business of selling mobile recharge coupons and Danny used to help his uncle in a pan-shop while Md. Tomba was rickshaw puller, Oken and Mujibur were taxi drivers and Ajgar was a businessman from Assam.
It also charged that the police personnel had falsely projected the deceased persons as terrorists or militants to justify their killing and that the police did not return the personal belongings to the family members and the deceased persons did not carry any weapon with them.
It is also mentioned that in the CBI charge sheet, sanctioned for prosecution under section 197 of the Code of Criminal Procedure (CrPC) against all 10 police personnel is awaited and shall be submitted to the court as when received from the competent authority.
On the other hand, police reports mentioned that during frisking and checking of all vehicles moving on the road at Awang Khunou after getting specific information about the movement of armed militants in the area, a motorcycle followed by a Tata Sumo vehicle was coming from Khumbong side.
When police signalled the said vehicles to stop, they attempted to escape by speeding up and also firing on the security personnel from inside the vehicle with sophisticated weapons; and the security personnel also retaliated and firing from both side continued for about five minutes. After the firing, the spot was searched, and six militants were found dead with bullet injuries.
The police team also recovered one US-made M-16 rifle, Calibre 5.56 MM- 31880 along with one magazine, 62 live rounds of M-16, two 9mm pistols with two magazines and seven live round, four empty cartridges of AK Rifle, one pistol holder along with one .32 pistol with magazines and two live rounds.
